Federal Judge Mandates Release of Kilmar Abrego Garcia from Immigration Custody

A federal judge has ordered the immediate release of Kilmar Abrego Garcia from immigration custody, finding his continued detainment is without lawful basis.

"Since Abrego Garcia's return from erroneous imprisonment in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis wrote in her order.

The situation stems from a mistaken removal to El Salvador in March, which the government later acknowledged was an error. Following his return to the United States to face human smuggling allegations, he was detained in federal detention.

In her decision, the court noted that the authorities does not have a current deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."

The court proceedings involve disputed assertions. While the former administration argues that Abrego Garcia is a member of the MS-13 gang, he vehemently disputes this allegation.

He has also entered a not guilty plea to the smuggling charges, which are part of a separate trial in Tennessee.
